Terms for the BAV App / Bold African Voice Network

Introduction
Welcome to the BAV App, operated by Bold African Voice Network, also referred to in these Terms as "BAV," "we," "us," or "our."
These Terms of Service govern your access to and use of the BAV App, website, live media services, community features, messaging tools, classifieds, news content, and any other services provided through the BAV platform.
By creating an account, accessing, downloading, or using the BAV App, you agree to these Terms. If you do not agree, please do not use the app.
1. About the BAV App
The BAV App is a digital media and community platform designed to connect Africans, people of African descent, and friends of Africa worldwide.
The app may include features such as BAV TV live streaming, BAV Radio streaming, African news and analysis, community chat rooms, direct messaging, audio and video calls, diaspora chapters and member networking, classified ads and local business listings, community announcements and events, user profiles and membership tools, and future services such as data top-up, donations, subscriptions, or digital payments.
We may add, remove, update, suspend, or modify any feature at any time.
2. Eligibility
You must be at least 13 years old to use the BAV App. If you are under the age of majority in your country, province, or state, you should use the app only with the permission of a parent or legal guardian.
By using the app, you confirm that you are legally allowed to use the app; the information you provide is accurate; you will follow these Terms and all applicable laws; and you will not use the app for unlawful, harmful, abusive, or fraudulent activity.
3. User Accounts
Some features require you to create an account. You are responsible for keeping your login details safe and for all activities under your account.
You agree not to create an account using false or misleading information; impersonate another person, organization, public figure, or business; share your account with unauthorized users; use another person's account without permission; or create accounts for spam, scams, harassment, or abuse.
We may suspend or delete accounts that violate these Terms or create risk for users, the platform, or the public.
4. Account Deletion
You may request deletion of your account through the app by going to: Menu -> My Account -> Delete Account
When you delete your account, we will process the request according to our Privacy Policy and applicable laws. Some information may be retained where necessary for legal, security, fraud prevention, dispute resolution, backup, or recordkeeping purposes.
Deleting your account may remove your profile, access to messages, chapter memberships, saved content, listings, and other app-related data.
5. Community Conduct
BAV is built to encourage respectful discussion, networking, African unity, public dialogue, and community engagement.
You agree not to post, send, upload, share, or promote content that harasses, threatens, abuses, or bullies others; promotes hate, violence, discrimination, or extremism; contains false, misleading, defamatory, or malicious claims; violates another person's privacy or safety; contains spam, scams, phishing, malware, or fraudulent offers; promotes illegal activity; includes sexually explicit, exploitative, or harmful material; impersonates another person or organization; violates intellectual property rights; or disrupts the app or interferes with other users' experience.
We may remove content, restrict features, suspend accounts, or take other action if we believe these rules are violated.
6. User Content
You may be able to post or share content through the app, including messages, comments, profile information, classified ads, business listings, images, audio, videos, links, reactions, and other materials.
You remain responsible for the content you share.
By posting content on BAV, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, distribute, moderate, and make your content available as needed to operate, promote, protect, and improve the app.
You confirm that you own or have permission to use any content you upload or share.
We do not guarantee that user content will remain available permanently.
7. Messaging, Calls, and Community Rooms
The BAV App may allow users to communicate through direct messages, public rooms, group discussions, audio calls, video calls, and other communication tools.
You agree to use these features respectfully and lawfully.
You must not use messaging or calling features to harass, threaten, intimidate, or abuse others; send spam, scams, or fraudulent offers; share private information without consent; record, distribute, or publish private communications without permission where prohibited by law; or promote violence, illegal activity, or harmful conduct.
BAV may moderate public spaces and may restrict accounts that misuse communication tools.
8. Classified Ads and Business Listings
The app may allow users to post classified ads, job postings, volunteer opportunities, business listings, services, events, donation appeals, or marketplace-style content.
BAV does not guarantee the accuracy, quality, legality, safety, or reliability of listings posted by users or third parties.
Users are responsible for verifying any person, business, product, service, job, donation request, or opportunity before engaging.
You agree not to post listings that are fraudulent, misleading, illegal, unsafe, discriminatory, exploitative, or prohibited by law.
BAV may remove listings at any time.
9. News, Commentary, and Media Content
BAV may provide news, commentary, analysis, live broadcasts, radio programming, videos, articles, headlines, and other media content.
Some content may be produced by BAV, while other content may come from third-party sources, public feeds, embedded services, licensed materials, or user-submitted content.
News and commentary are provided for informational, educational, and community discussion purposes. They should not be treated as legal, financial, medical, or professional advice.
We may update, edit, remove, or correct content at any time.
10. Third-Party Content and Services
The BAV App may include links, embedded players, feeds, videos, websites, payment services, telecom services, advertising, analytics, or content from third parties.
We are not responsible for third-party websites, platforms, content, policies, products, services, or actions.
Your use of third-party services may be subject to their own terms, privacy policies, fees, and rules.
BAV does not guarantee that third-party services will always be available, accurate, safe, or uninterrupted.
11. Media Streaming Rights
BAV aims to provide lawful access to its own media content, authorized streams, licensed content, embedded public content, or content made available through permitted third-party services.
Users may not use the app to upload, stream, rebroadcast, distribute, or share copyrighted audio, video, music, images, or other content unless they own the rights or have permission.

We may remove content that appears to violate copyright, trademark, privacy, or other rights.
12. Payments, Donations, Subscriptions, and Future Services
BAV may offer paid features in the future, including but not limited to subscriptions, donations, sponsorships, advertising, premium listings, digital services, or mobile data top-up.
If paid features are introduced, prices, fees, taxes, and refund rules will be shown before purchase where applicable. Payments may be processed by third-party providers. Some purchases may be subject to app store rules, payment processor rules, telecom aggregator rules, or local laws. Refunds may depend on the type of service, whether the service has been delivered, and applicable consumer protection laws.
For services such as mobile data top-up, airtime, donations, or digital delivery, BAV may provide separate terms, refund policies, transaction rules, and support procedures.
13. Donations and Community Fundraising
The app may include donation appeals, scholarship campaigns, nonprofit initiatives, or community support programs.
Unless clearly stated otherwise, donations may be processed by third-party payment providers and may be subject to additional terms.
BAV will make reasonable efforts to describe donation campaigns clearly, but users are responsible for reviewing donation details before contributing.
Donation refunds may be limited once funds have been processed or distributed, unless required by law.
14. Intellectual Property
The BAV name, logo, brand identity, app design, graphics, software, original articles, broadcasts, programs, and other platform materials belong to BAV or its licensors.
You may not copy, reproduce, modify, distribute, sell, or exploit BAV's intellectual property without written permission.
You may share BAV content using official sharing tools or links, provided you do not misrepresent the content or remove branding, credits, or legal notices.
15. App Availability and Changes
We aim to keep the app reliable, but we do not guarantee that the app will always be available, error-free, secure, or uninterrupted.
The app may be affected by maintenance, updates, internet issues, third-party service failures, device compatibility, app store rules, technical problems, or events beyond our control.
We may modify, suspend, restrict, or discontinue any part of the app at any time.
16. Safety, Moderation, and Enforcement
To protect users and the platform, BAV may review reported content; remove posts, listings, or messages; restrict access to features; suspend or terminate accounts; block abusive users; cooperate with legal authorities where required; and take steps to prevent fraud, spam, abuse, or security threats.
We are not obligated to monitor all content, but we may moderate content where appropriate.

Your use of the BAV App is also governed by our Privacy Policy, which explains how we collect, use, store, protect, and share personal information.

18. Prohibited Uses
You must not use the BAV App to break any law or regulation; harm, exploit, threaten, or harass others; spread malware, spam, phishing links, or scams; interfere with the app's security or performance; scrape, copy, reverse engineer, or misuse app data; use bots or automated tools without permission; misrepresent your identity or affiliation; post illegal, unsafe, or harmful goods or services; violate intellectual property, privacy, or publicity rights; or use the app in a way that damages BAV's reputation, users, partners, or systems.
19. Disclaimer of Warranties
The BAV App is provided on an "as is" and "as available" basis.
We do not guarantee that the app will always work without interruption; content will always be accurate or complete; third-party services will always be available; messages, calls, streams, listings, or news feeds will always function perfectly; or the app will meet every user expectation.
To the fullest extent permitted by law, BAV disclaims all warranties, whether express or implied.
20. Limitation of Liability
To the fullest extent permitted by law, BAV, its owners, officers, employees, contractors, partners, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the app.
This includes loss of data, loss of business, loss of revenue, service interruption, user disputes, third-party actions, inaccurate listings, failed communications, or unauthorized account access.
Nothing in these Terms limits liability where the law does not allow such limitation.
21. User Responsibility and Indemnity
You agree to be responsible for your use of the BAV App and any content you post or share.
You agree to defend, indemnify, and hold harmless BAV from claims, losses, damages, liabilities, costs, or expenses arising from your violation of these Terms; your misuse of the app; your content; your violation of another person's rights; or your unlawful conduct.
22. Suspension or Termination
We may suspend, restrict, or terminate your account if you violate these Terms; misuse the app; your activity creates legal, security, or reputational risk; we are required to do so by law; or the app or a feature is discontinued.
You may stop using the app at any time and may request account deletion through the app.
23. Governing Law
These Terms are governed by the laws of Ontario/Canada, without regard to conflict of law rules.
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.
24. Dispute Resolution
If a dispute arises, you agree to first contact BAV so we can try to resolve the issue informally.

If the issue cannot be resolved informally, disputes may be handled through the courts or dispute resolution process available in the governing jurisdiction, unless applicable law requires otherwise.
25. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date.
For significant changes, we may notify users through the app, website, email, or other reasonable methods.
Your continued use of the app after changes means you accept the updated Terms.
